Review of the New Workers' Compensation Law

Administrative Law Judge Carl Mueller has prepared a 20-page review of the new workers' compensation law.  He has included the following improvements to the version that was published in the May, 2005 newsletter:

  • A more in-depth discussion of the changes affecting truck drivers and trucking companies (287.040, 287.041 & 287.043), personal leave and TTD (287.140.14), the temporary award penalty section (287.510), the SIF Surcharge Cap (287.715), and additional case references discussing the new law's impact on them, to name a few;

  • Two new items: one discussing effective dates, and the other addressing what provisions might be substantive versus procedural and the impact of both interpretations;

  • An expanded topic index; and,

  • A separate case index.
Lawmakers recently acknowledged that §287.110.1 of the law was enacted with a drafting error. Judge Mueller has updated his review to address the impact of this error (see item 6 at page 6) and other recent developments including why employers already can require employees to use paid-leave benefits to cover time away from work for follow-up medical care (see item 14 at page 10).
