Complex Issues in Guardianships, Conservatorships & Special Needs Trusts

A significant portion of our population is dealing with friends and family members who have a disability or special needs. Few areas of the law raise issues as interesting, complex and ethically challenging as guardianship. This program will identify and address many of those complex issues, including the importance and ethics of evaluating your client’s capacity, communication and maintaining confidentiality, multi-state guardianship/conservatorship issues, the complicated conflicts of interest created by the overlap of financial, legal, and medical decision making issues, restoring an incapacitated persons’ rights and terminating guardianships. The program will conclude with an in-depth discussion of the different government benefits programs and the role and importance of special needs trusts in planning for persons with disabilities.
