Supreme Court Rule Changes

On April 27, 1999, the Missouri Supreme Court adopted a new subdivision 51.15 (Disqualification of Family Court Commissioner) of Supreme Court Rule 51 entitled "Venue, Including Change of Venue and Change of Judge."

In the same order, the Court repealed subdivision (b) of subdivision 54.06 (Service Outside the State on Persons, Firms or Corporations Who Do Certain Acts in this State) of Supreme Court Rule 54, entitled "Issuance and Service of Summons or Other Process," and adopted in its place a new subdivision (b) of subdivision 54.06 (Service Outside the State on Persons, Firms or Corporations Who Do Certain Acts in this State).

The Court, in the same order, adopted a new subdivision 55.34, entitled "Remand of Case Removed to Federal Court," of Supreme Court Rule 55, entitled "Pleadings and Motions."

Also in the order, the Court repealed subdivision 57.01(a), entitled "Availability; Procedures for Use" of Supreme Court Rule 57, entitled "Interrogatories and Depositions," and in lieu thereof adopted a new subdivision 57.01(a).

In the same order, the Court repealed subdivision 83.01 (Transfer on Dissent of Participating Judge), subdivision 83.02 (Transfer on Order of Court of Appeals), subdivision 83.03 (Transfer by Supreme Court After Opinion by Court of Appeals", subdivision 83.04 (Application - Form - Contents), subdivision 83.05 (Suggestions - Number of Pages), subdivision 83.06 (Transfer Upon Application Prior to Opinion) and subdivision 83.07 (Notice to Parties - Counter Suggestions) of Supreme Court Rule 83, entitled "Transfers from District of Court of Appeals to this Court and Related Matters - Procedure in the Supreme Court," and adopted a new subdivision 83.01 (Transfer Upon Application Prior to Disposition by Court of Appeals", a new subdivision 83.02 (Transfer on Order of Court of Appeals), a new subdivision 83.03 (Transfer on Dissent of Participating Judge), a new subdivision 83.04 (Transfer by Supreme Court After Opinion by Court of Appeals), a new subdivision 83.05 (Application - Form - Contents) and a new subdivision 83.06 (Notice to Parties - Counter-Suggestions) of Supreme Court Rule 83, entitled "Transfers from the Court of Appeals to This Court."

The order becomes effective January 1, 2000.

The Missouri Supreme Court, in an order dated April 27, 1999, repealed subdivision (2) of Canon 5(B), entitled "Campaign Conduct," of Supreme Court Rule 2 (Code of Judicial Conduct) and in lieu thereof adopted a new subdivision (2) of Canon 5(B), entitled "Campaign Conduct."

The order became effective July 1, 1999.

On April 28, 1999, the Supreme Court of Missouri repealed subdivision 13.02 (Requirements and Limitations) and subdivision 13.03 (Certification) of Supreme Court Rule 13, entitled "Legal Assistance by Law Students," and adopted a new subdivision 13.02 (Requirements and Limitations) and a new subdivision 13.03 (Certification).

The order became effective July 1, 1999.

The Missouri Supreme Court, in an order dated May 14, 1999, repealed subdivision 5.28, entitled "Reinstatement," of Supreme Court Rule 5 (Complaints and Proceedings Thereon) and adopted in its place a new subdivision 5.28, entitled "Reinstatement."

In the same order, the Court repealed Supreme Court Rule 6 entitled "Annual Enrollment Statement," consisting of subdivisions 6.01 to 6.08, inclusive, and in lieu thereof adopted a new Supreme Court Rule 6, entitled, "Annual Enrollment," consisting of subdivisions 6.01 to 6.11, inclusive.

The Court, in the same order, repealed subdivision 8.03 (Eligibility to Take the Bar Examinations) and subdivisions (b) and (c) of subdivision 8.05 (Qualifications) of Supreme Court Rule 8, entitled "Admission to the Bar," and adopted in lieu thereof a new subdivision 8.03 (Eligibility to Take the Bar Examinations) and new subdivisions (b) and (c) of subdivision 8.05 (Qualifications).

Also in this order, the Court repealed subdivision (b) of subdivision 9.09, entitled "Foreign Legal Consultants - Application and Annual Fees," of Supreme Court Rule 9, entitled "Practice by Nonresident Attorneys," and adopted in its place a new subdivision (b) of subdivision 9.09, entitled "Foreign Legal Consultants - Application Procedure."

In the same order, the Court repealed subdivision (e) of subdivision 15.05 (Continuing Legal Education Requirements) of Supreme Court Rule 15 (Continuing Legal Education) and adopted in its place a new subdivision (e) of subdivision 15.05 (Continuing Education Requirements).

The order will become effective January 1, 2000.
