Supreme Court Rule Changes

The Missouri Supreme Court, in an order dated March 17, 2003, repealed subdivision 24.09 (Misdemeanors or Felonies – Application for Continuance – How Made) of Rule 24, entitled "Misdemeanors or Felonies – Arraignment and Proceedings Before Trial," and adopted a new subdivision 24.09 (Misdemeanors or Felonies – Application for Continuance – How Made).

This order becomes effective January 1, 2004.

On April 25, 2003, the Supreme Court of Missouri repealed subdivision 76.16, entitled "Notice of Sale," of Rule 76 (Executions) and in lieu thereof adopted a new subdivision 76.16, entitled "Notice of Sale."

In the same order, the Court repealed subdivision (a)(1) of subdivision 84.24 (Procedure as to Original Writs) of Rule 84, entitled "Procedure in All Appellate Courts," and adopted a new subdivision (a)(1) of subdivision 84.24 (Procedure as to Original Writs).

Also in the order, the Court repealed subdivision 94.03, entitled "Petition in Mandamus – Contents – Exhibits," of Rule 94 (Mandamus) and in lieu thereof adopted a new subdivision 94.03, entitled "Petition in Mandamus – Contents – Exhibits."

The Court, in the same order, repealed subdivision 97.03 (Petition in Prohibition – Contents – Exhibits) of Rule 97, entitled "Prohibition," and adopted a new subdivision 97.03 (Petition in Prohibition – Contents – Exhibits).

Additionally, in this order, the Court repealed subdivision 98.03, entitled "Petition in Quo Warranto – Contents – Exhibits," of Rule 98, entitled "Quo Warranto," and in lieu thereof adopted a new subdivision 98.03, entitled "Petition in Quo Warranto – Contents – Exhibits."

In the same order, the Court repealed subdivision 121.01 (Termination, When) of Rule 121, entitled "Termination of Parental Rights," and adopted a new subdivision 121.01 (Termination, When).

Also in the order, the Court repealed subdivision 128.14, entitled "Petition," of Rule 128 (Forms) and adopted a new subdivision 128.14, entitled "Petition."

And, the Court, in this order, repealed the Civil Procedure Form No. 16, entitled "Summary for Original Remedial Writs," and in lieu thereof adopted a new Civil Procedure Form No. 16, entitled "Summary for Original Remedial Writs."

This order becomes effective January 1, 2004.
