Supreme Court Rule Changes

In an order dated October 9, 2001, the Supreme Court of Missouri corrected subdivisions 5. 04(a), 5.04(c), 5.06(b), 5.08(b) and 5.09 of Court Operating Rule 5.

This order became effective January 1, 2002.

The Supreme Court of Missouri, in an order dated October 19, 2001, repealed subdivisions (d) and (e) of subdivision 4-1.11, entitled "Successive Government and Private Employment," of Supreme Court Rule 4 (Rules of Professional Conduct) and adopted new subdivisions (d), (e) and (f) of subdivision 4-1.11, entitled "Government and Private Employment."

The Court, in the same order, adopted new Supplemental Missouri Comment for Rule 4-1.11(d).

This order became effective October 19, 2001.

On November 21, 2001, the Supreme Court of Missouri repealed the Regulations of the Board of Law Examiners to subdivision 8.04 (Registration of Law Students) of Supreme Court Rule 8, entitled "Admission to the Bar," and in lieu thereof adopted new Regulations of the Board of Law Examiners to subdivision 8.04 (Registration of Law Students).

This order became effective January 1, 2002.

In an order dated December 18, 2001, the Supreme Court of Missouri repealed subdivision 29.11(d), entitled "Motion for New Trial in Jury-Tried Cases – Allegation of Error Required," and subdivision 29.11(e), entitled "Motions for New Trial in Cases Tried Without a Jury – Allegations of Error Required," of Rule 29 (Misdemeanors or Felonies – Verdict, Sentence and New Trial) and adopted a new subdivision 29.11(d), entitled "Motion for New Trial in Jury-Tried Cases – Allegation of Error Required," and a new subdivision 29.11(e), entitled "Motions for New Trial in Cases Tried Without a Jury."

This order becomes effective July 1, 2002.

On December 18, 2001, the Supreme Court of Missouri repealed subdivision (c) of subdivision 5.22 (Trial and Disposition of Cause Directly Filed in This Court) of Rule 5, entitled "Complaints and Proceedings Thereon," and in lieu thereof adopted a new subdivision (c) of subdivision 5.22 (Trial and Disposition of Cause Directly Filed in This Court).

This order became effective December 18, 2001.

The Supreme Court of Missouri, in an order dated December 18, 2001, corrected an order adopting Rule 69.03

This order became effective January 1, 2002.

The Supreme Court of Missouri, in an order dated January 28, 2002, repealed Rule 21, entitled "Procedure Applicable to Misdemeanors Only," consisting of subdivisions 21.01 to 21.10, inclusive, and adopted a new Rule 21, entitled "Procedure Applicable to Misdemeanors Only," consisting of subdivisions 21.01 to 21.10, inclusive.

The Court, in the same order, repealed Rule 22 (Procedure Applicable to Felonies Only) consisting of subdivisions 22.01 to 22.08, inclusive, and in lieu thereof adopted a new Rule 22 (Procedure Applicable to Felonies Only) consisting of subdivisions 22.01 to 22.08, inclusive.

Also in the order, the Court repealed Rule 23, entitled, "Misdemeanors or Felonies – Indictment or Information," consisting of subdivisions 23.01 to 23.11, inclusive, and adopted a new Rule 23, entitled, "Misdemeanors or Felonies – Indictment or Information," consisting of subdivisions 23.01 to 23.11, inclusive.

In the same order, the Court adopted a new subdivision 27.09 (Juror Confidentiality) of Rule 27, entitled "Misdemeanors or Felonies – Trial."

Additionally, the Court repealed subdivision 84.04(h), entitled "Appendix," of Rule 84 (Procedure in Appellate Courts) and adopted in lieu thereof a new subdivision 84.04(h), entitled "Appendix."

This order becomes effective January 1, 2003.
