Spring 2007 Committee Meeting Minutes
The following summary is arranged under the items on the circulated agenda. The agenda appears in bold and the summary in regular type.
1. Welcome & Introductions
New members in attendance were introduced and all members were given an opportunity to introduce themselves while an attendance sheet was circulated.
2. CLE Program: Arbitration Law Update: Recent Matters of Interest & Importance
The arbitration law update program was provided by Jim Keller. Please refer to the ADR Committee web page for the comprehensive materials that were compiled for, and reviewed during, the program.
3. Subcommittee Reports (Please note that copies of the subcommittee reports will be available on the ADR Committee web page located under the Services & Resources/Missouri Bar Activities section of mobar.org.)
A. Arbitration
Report incorporated into the above CLE program.
B. Mediation
Report provided by Dave Gibbons.
C. Collaborative Law
Potential Collaborative Law trainings were discussed for October 11 to coordinate with a program planned by the University of Missouri Law School.
Also discussed were the implication s of an ethical opinion issued in Colorado relating to Collaborative Law. An electronic report was also provided by Steve Stark following the meeting, which will be available on the ADR Committee web page (see above).
D. Legislation
Sarah Read gave a brief overview of the committee’s efforts on Senate Bill 22, which lead to a clarification in the language of the bill.
4. Discussion with Chris Janku on Rule 17
Chris Janku of the Missouri Bar reported on the progress that has been made in getting an updated fully searchable version of the Rule 17 ADR neutral list on the MOBar website, which should be available some time in mid-August. Members may review their information through the following link (http://members.mobar.org/Rule17/Search.aspx) and are asked to email any comments to Sarah Read (sjr@readadr.com). Please do not make edits to your information at this time. An e-mail announcement will be circulated once the list has been uploaded to the MOBar website, and you will be able to make changes at a later date. Various members of the committee have had an opportunity to test a model for this list, and we are excited about this additional resource.
5. Discussion with Judge Lynch
Judge Lynch, of the Missouri Court of Appeals, Southern District, discussed the new “Lawyer to Lawyer Dispute Committee” . The final rule as passed by the committee will be available on the ADR Committee web page located under the Services & Resources / Missouri Bar Activities section of mobar.org. The Board of Governors will be considering this proposed rule at their upcoming meeting on July 20th in Branson. After reviewing the rule and guidelines, please respond by email to Sarah Read (sjr@readadr.com) with your comments, questions, and concerns by July 18th. These will be forwarded to Judge Lynch.
The ADR Committee also discussed the new committee on limited scope legal services and several members recommended reading the article by Kathleen Bird entitled “A Look at Unbundling of Legal Services”, which appeared in the January/February 2007 issue of The Journal of The Missouri Bar.
6. Discussion of Future CLE Programs
In addition to the plans for a Collaborative Law training in October discussed above, possible ADR teleconference CLEs were discussed. The committee will be working with Dee Shepherd to follow up on this idea.
7. Discussion of Legislative Project
There was a discussion on legislation and steps that might be taken to further educate legislators about ADR options and benefits.
8. New Business
Sarah Read asked any committee member interested in being a Vice Chair or a subcommittee chair or co-chair to contact her.
