Impasse: What Causes It, How to Avoid It, and How to Work Through It - October 11, 2011

Impasse occurs when people in a dispute get stuck, when they can’t figure out how to move forward, or when they can’t figure out how to solve a dispute to their mutual satisfaction. The common threat when impasse occurs is to let the judge or jury decide how to break the gridlock. While this is a viable option in most cases, it is rarely a satisfactory one for the people who have to live with the decision. It’s important for people in a dispute to understand that impasse is normal. Normalizing impasse opens opportunities for parties, as well as their attorneys, to think outside the box. It’s critical for attorneys to understand why and how people get stuck in order to help their clients avoid or work through impasse. This understanding goes beyond the legal issues; there must also be an understanding of the emotional and business issues that accompany any dispute. Attorneys who have a deeper understanding of the many underlying issues in any dispute and an ability to truly listen to what really matters to clients will be in a better position to assist their clients in ways that are meaningful to clients. Whether an attorney is in the advocate’s role or the mediator’s role, developing a deeper understanding of the causes and cures for impasse will help any attorney provide client-centered services that lead to improved decision-making and higher levels of satisfaction.
