Supreme Court Rule Changes

On September 20, 2007, the Supreme Court of Missouri repealed Form No. 8-A, entitled “Notice of Appeal,” and adopted a new Form No. 8-A, entitled “Notice of Appeal.”

This order becomes effective January 1, 2008.

The Supreme Court of Missouri, in an order dated October 2, 2007, repealed Comment [9], entitled “Disputes Over Fees,” to subdivision 4-1.5 (Fees) of Rule 4, entitled “Rules of Professional Conduct,” and in lieu thereof adopted a new subdivision (f) of subdivision 4-1.5 (Fees).

In the same order, the Court adopted a new subdivision 4-6.6 (Provision of Legal Services Following Determination of Major Disaster) of Rule 4, entitled “Rules of Professional Conduct,” and a Comment thereto.

Additionally, the Court repealed subdivision 5.10 (Resolution of Complaints) of Rule 5, entitled “Complaints and Proceedings Thereon,” and adopted a new subdivision 5.10 (Resolution of Complaints) and new Lawyer-to-Lawyer Dispute Resolution Program Guidelines thereto.

This order becomes effective January 1, 2008.

In an order dated October 25, 2007, the Supreme Court of Missouri repealed subdivision 5.14 (Peremptory Challenges – Assignment to Disciplinary Hearing Panel – Duty of Chief Disciplinary Counsel – Failure to Request or Attend Hearing), subdivision 5.16 (Decision of Disciplinary Hearing Panel – Findings and Recommendations), subdivision 5.19 (Procedure Following Decision of a Disciplinary Hearing Panel), subdivision 5.27 (Notification of Clients and Counsel) and subdivision 5.28 (Reinstatement) of Rule 5, entitled “Complaints and Proceedings Thereon,” and in lieu thereof adopted a new subdivision 5.14 (Peremptory Challenges – Assignment to Disciplinary Hearing Panel – Duty of Chief Disciplinary Counsel – Failure to Request or Attend Hearing), a new subdivision 5.16 (Decision of Disciplinary Hearing Panel – Findings and Recommendations), a new subdivision 5.19 (Procedure Following Decision of a Disciplinary Hearing Panel), a new subdivision 5.27 (Procedure Following a Disbarment of Suspension Order, and a new subdivision 5.28 (Reinstatement).

This order becomes effective January 1, 2008.
