Supreme Court Rule Changes

The Supreme Court of Missouri, in an order dated December 5, 2005, repealed subdivision (e) of subdivision 14.06, "Admission Without Examination," and subdivision 14.07, "Appointment of Official Court Reporter - Temporary Appointment," of Rule 14 (Certified Court Reporters) and adopted a new subdivision (e) of subdivision 14.06, "Admission Without Examination," and a new subdivision 14.07, "Appointment of Official Court Reporter - Temporary Appointment."

This order became effective January 1, 2006.

In an order dated December 15, 2005, the Supreme Court of Missouri repealed subdivision 21.01 (Amount of Costs, Fees, Miscellaneous Charges and Surcharges) and subdivision 21.02 (Distribution of Fees) of Court Operating Rule 21, "Court Costs, Fees, Miscellaneous Charges and Surcharges," and adopted a new subdivision 21.01, (Amount of Costs, Fees, Miscellaneous Charges and Surcharges) and a new subdivision 21.02, (Distribution of Fees).

This order becomes effective July 1, 2006.

The Supreme Court of Missouri, in an order dated December 20, 2005, adopted a new subdivision 21.06, "Participation in Missouri Court Tax Offset Program," of Court Operating Rule 21, "Court Costs, Fees, Miscellaneous Charges and Surcharges."

This order becomes effective July 1, 2006.

In an order dated December, 20, 2005, the Supreme Court of Missouri repealed subdivision 54.11 (Service on Resident or Nonresident Motor Carrier) of Rule 54, "Issuance and Service of Summons and Other Process."

The Court, in the same order, repealed subdivision 76.02, entitled "Form of Writ of Execution," of Rule 76 (Executions).

Additionally, the Court repealed subdivision 81.04(d), "Docket Fees," subdivision 81.12(e), "Errors - Omissions - Supplemental Record on Appeal," and subdivision 81.16, "Exhibits - Records on Appeal - Transcript, Exhibits Need Not be Incorporated," of Rule 81 (Appeals), and adopted a new subdivision 81.04(d), "Docket Fees," a new subdivision 81.12(e), "Exhibits - Appellant Shall Deposit," a new subdivision 81.12(f), "Errors - Omissions - Supplemental Record on Appeal," and a new subdivision 81.16, "Exhibits - Records on Appeal - Transcript, Exhibits Need Not Be Incorporated."

In the same order, the Court repealed subdivision 92.01 (Who May Grant) of Rule 92, "Injunctions," and adopted a new subdivision 92.01 (Who May Grant).

The Court also repealed Criminal Procedure Form No. 23, entitled "General Affidavit of Qualification of Bondsmen;" Criminal Procedure Form No. 24, entitled "Special Affidavit of Qualification of Bondsmen;" "Petition," "Petition for a Minor," "Counterclaim Arising Out of Same Transaction," "Counterclaim Not Arising Out of Same Transaction," "Satisfaction of Judgment," and "Dismissal" under Rule 152, entitled "Forms for Small Claims Division;" and "Petition for Expungement of Arrest Records" under Rule 155, entitled, "Expungement of Arrest Records."

In the same order, the Court corrected Civil Procedure Form No. 6-A, "Order for Service by Publication of Notice."

This order becomes effective July 1, 2006.
