Supreme Court Rule Changes

The Supreme Court of Missouri, in an order dated December 10, 2008, vacated an order dated June 23, 2008, adopting changes to Rule 56.01 (b)(4) relating to discovery from experts.

This order was effective December 10, 2008.

In an order dated December 11, 2008, the Supreme Court of Missouri repealed subdivision 6.01(f), entitled “Automatic Suspension,” of Rule 6 (Fees to Practice Law) and adopted a new subdivision 6.01(f), entitled “Automatic Suspension.”

The Court, in the same order, repealed subdivision 9.01, entitled “Unauthorized Practice by Foreign Attorneys,” of Rule 9 (Practice by Nonresident Attorneys) and adopted a new subdivision 9.01, entitled “Unauthorized Practice by Foreign Attorneys.”

Additionally, the Court repealed Criminal Procedure Form No. 36.

This order was effective January 1, 2009.

The Supreme Court of Missouri, in an order dated December 18, 2008, repealed subdivisions 17.21, 17.23, 17.25, 17.32, 17.33, and 17.40 of Court Operating Rule 17, entitled “Case Processing Time Standards,” and in lieu thereof adopted new subdivisions 17.21, 17.23, 17.25, 17.26, 17.27,17.32, 17.33, and 17.40 of Court Operating Rule 17, entitled “Case Processing Time Standards.”

This order was effective January 1, 2009.

In an order dated January 6, 2009, the Supreme Court of Missouri repealed subdivision (a)(3)(A)(ii) and subdivision (i)(5) of Rule 4-1.15, entitled “Safekeeping Property,” of Rule 4 (Rules of Professional Conduct) and adopted a new subdivision (a)(3)(A)(ii) and a new subdivision (i)(5) of Rule 4-1.15, entitled “Safekeeping Property.”

This order was effective January 6, 2009.

In re: Forms for use by parties not represented by counsel in certain proceedings

O R D E R

 1. The materials attached hereto, having been prepared by this Court’s Committee on Access to Family Courts and reviewed by the Court, are hereby adopted and approved.

 2. Pursuant to Rule 88.09, the forms attached hereto shall be accepted by the courts of this state until disapproved or superceded by this Court. Effective April 1, 2009, every party not represented by counsel who participates in a proceeding for dissolution of marriage shall use the forms attached if applicable. Use of these forms prior to April 1, 2009, is permitted, but is not required.

 3. It is further ordered that this order shall be published in the South Western Reporter and the Journal of The Missouri Bar. The materials attached need not be published with the order if reference is made that the materials can be accessed at http://www.courts.mo.gov/page.asp?id=3832 “Representing Yourself in Missouri Courts: Access to Family Courts.”
