Supreme Court Rule Changes
The Supreme Court of Missouri, in an order dated November 14, 2007, adopted a new subdivision (d) of subdivision 7.03 (Board of Governors) and repealed subdivision 7.05 (Terms) of Rule 7, entitled “Establishing and Providing for the Government of The Missouri Bar,” and adopted a new subdivision 7.05 (Terms).
This order became effective January 1, 2008.

In an order dated December 18, 2007, the Supreme Court of Missouri corrected an order dated August 21, 2007 repealing subdivision 4-1.15, entitled “Safekeeping Property,” of Rule 4, “Rules of Professional Conduct.”
This order became effective January 1, 2008.

The Supreme Court of Missouri, in an order dated December 18, 2007, adopted a new subdivision (d) of subdivision 5.29, entitled “Unauthorized Practice of Law,” of Rule 5 (Complaints and Proceedings Thereon).
This order became effective January 1, 2008.

In another order dated December 18, 2007, the Supreme Court of Missouri repealed subdivision 8.03 (Requirements for Admission to the Bar), subdivision (d) and Regulation 4 of subdivision 8.07 (Application for Bar Examination) and subdivision (d) of subdivision 8.11 (Approval of Applications) of Rule 8, “Admission to the Bar,” and adopted a new subdivision 8.03 and a new Regulation 5 to said subdivision (Requirements for Admission to the Bar), new subdivisions (d) and (e) and a new Regulation 4 of subdivision 8.07 (Application for Bar Examination) and a new subdivision (d) of subdivision 8.11 (Approval of Applications).
This order became effective January 1, 2008.

The Supreme Court of Missouri, in an additional order dated December 18, 2007, repealed subdivision 57.06 (Commissioner for Deposition) of Rule 57, entitled “Interrogatories and Depositions” and adopted a new subdivision 57.06, entitled “Presiding Officer for Deposition.”
The Court, in the same order, adopted a new subdivision (h) of subdivision 68.01 (Masters in Circuit Courts) of Rule 68, entitled “Masters and Receivers.”
Additionally, the Court repealed subdivision 74.04(c), entitled “Motions and Proceedings Thereon,” of Rule 74 (Judgments, Orders and Proceedings Thereon) and adopted a new subdivision 74.04(c), entitled “Motions and Proceedings Thereon.”
In the same order, the Court repealed subdivision 78.10 (Remittitur – Effect of Consenting to Remittitur) of Rule 78, “New Trials – After-trial Motions – Preservation of Error,” and adopted a new subdivision 78.10 (Additur and Remittitur).
The Court also repealed subdivision (b) or subdivision 81.18 (Form of Typewritten Transcripts and Other Documents) of Rule 81, “Appeals,” and adopted a new subdivision (b) of subdivision 81.18 (Form of Typewritten Transcripts and Other Documents).
In the same order, the Court repealed subdivision 84.05(a), entitled “Service and Filing – Time of;” subdivision 84.05(b), entitled “Service and Filing – Time of – Cross Appeals;” subdivision 84.06(g), entitled “Electronic Copy – Filing;” and subdivision 84.06(h), entitled “Briefs by Electronic Mail in this Court,” of Rule 84 (Procedure in All Appellate Courts) and in lieu thereof adopted a new subdivision 84.05(a), entitled “Filing and Service – Time of;” a new subdivision 84.05(b), entitled “Filing and Service – Time of – Cross Appeals;” a new subdivision 84.06(g), entitled “Electronic Copy – Filing;” and a new subdivision 84.06(h), entitled “Briefs by Electronic Mail in this Court.”
Additionally, the Court corrected a reference to “Rule 84.05 (g)” contained in subdivision 84.04(h), entitled “Appendix,” of Rule 84 (Procedure in All Appellate Courts).
The Court, in the same order, corrected the word “requires” contained in subdivision 68.01(e), entitled “Powers,” of Rule 68 (Masters in Circuit Court).
Also, the Court vacated portions of the Court’s order of June 26, 2007 relating to subdivision 56.02 (Master of Discovery); subdivision 57.06 (Commissioner for Depositions); and subdivision 68.01(h), entitled “Masters in Circuit Courts.”
This order becomes effective July 1, 2008.

In an order dated December 21, 2007, the Supreme Court of Missouri adopted a new Court Operating Rule 25, entitled “Services by Court Clerks and Staff In Family Law Cases.”

The Supreme Court of Missouri, in an order dated, December 21, 2007, repealed subdivision (c) of subdivision 4-1.2 (Scope of Representation), the Comment to subdivision 4-1.2, and subdivision (c) of subdivision 4-1.16 (Declining or Terminating Representation) of Rule 4, entitled “Rules of Professional Conduct,” and in lieu thereof adopted a new subdivision (c) of subdivision 4-1.2 (Scope of Representation), a new Comment to subdivision 4-1.2, including a “Notice and Consent to Limited Representation,” and a new subdivision (c) of subdivision 4-1.16 (Declining or Terminating Representation).
In the same order, the Court repealed subdivision 43.01(b), entitled “Service on Attorney,” of Rule 43 (Service of Pleadings and Other Papers) and adopted a new subdivision 43.01(b), entitled “Service on Attorney.”
Additionally, the Court repealed subdivision 55.03 (Signing of Pleadings, Motions and Other Papers; Representations to Court; Sanctions) of Rule 55, entitled “Pleadings and Motions,” and adopted a new subdivision 55.03 (Signing of Pleadings, Motions and Other Papers; Appearance and Withdrawal of Counsel; Representations to Court; Sanctions).
The Court, in the same order, adopted a new subdivision 88.09 (Parties not Represented by Counsel) of Rule 88, entitled “Dissolution, Legal Separation and Child Support.”
This order becomes effective July 1, 2008.
