Supreme Court Rule Changes

          

            The Supreme Court of Missouri, in an order dated January 6, 2006, repealed subdivision 7.10, “Headquarters Building,” of Rule 7 (Establishing and Providing for the Government of The Missouri Bar) and adopted a new subdivision 7.10, “Headquarters Building.”

            This order became effective January 6, 2006.

            In an order dated January 12, 2006, the Supreme Court of Missouri repealed subdivision 6.01(d), “Persons Exempt from Fee,” of Rule 6 (Annual Enrollment Statement) and adopted a new subdivision 6.01(d), “Persons Exempt from Fee.”

            This order became effective January 12, 2006.

            The Supreme Court of Missouri, in an order dated January 31, 2006, repealed subdivision 8.10, “Admission Without Examination,” and the Regulations of the Board of Law Examiners thereto of Supreme Court Rule 8 (Admission to the Bar) and in lieu thereof adopted a new subdivision 8.10, “Admission Without Examination,” and new Regulations of the Board of Law Examiners thereto.

            This order becomes effective July 1, 2006.

            In an order dated January 31, 2006, the Supreme Court of Missouri adopted a new subdivision 5.085, entitled “Period of Limitation,” of Rule 5, entitled “Complaints and Proceedings Thereon.”

            This order becomes effective January 1, 2007.

            The Supreme Court of Missouri, in an order dated March 1, 2006, repealed subdivision (a) and (d) of subdivision 5.28, “Reinstatement,” of Rule 5 (Complaints and Proceedings Thereon), and adopted a new subdivisions (a) and (d) of subdivision 5.28, “Reinstatement.”

            In the same order, the Court repealed subdivision 6.05 (Unauthorized Practice by Stricken or Inactive Lawyers) of Rule 6, “Fees to Practice Law,” and adopted a new subdivision 6.05 (Unauthorized Practice by Suspended, Stricken or Inactive Lawyers).

            The Court, in the same order, repealed subdivision (f) of subdivision 15.06, “Reporting Requirements – Sanctions – Review,” and in lieu thereof adopted a new subdivision (f) of subdivision 15.06, “Reporting Requirements – Sanctions – Review.”

            This order became effective April 3, 2006.

Your verdict must be for plaintiff if you believe:

 

First, defendant knew or had information from which defendant, in the exercise of ordinary care1, should have known that trespassers constantly intruded on (here describe the limited area of land on which trespassing occurred), and

Second, defendant [maintained][created]2 (here describe the artificial condition that caused the injury), and

Third, defendant knew that such condition was likely to cause death or serious bodily harm to trespassers, and

Fourth, defendant knew or had information from which defendant, in the exercise of ordinary care,1 should have known that trespassers would not discover such condition, and

The law on liability to constant trespassers is set forth in Restatement

(Second) of Torts section 335 (1965), which was expressly adopted in Humphrey v. Glenn, 167 S.W.3d 680, 684 (Mo. banc 2005).

Section 335 provides that:

 

A possessor of land who knows, or from facts within his knowledge should know, that trespassers constantly intrude upon a limited area of land, is subject to liability for bodily harm caused to them by an artificial condition on the land, if

 

(a)   the condition

 

(i)        is one which the possessor has created or maintains, and

 

(ii)       is, to his knowledge, likely to cause death or serious bodily harm to such trespassers, and

 

(iii)      is of such a nature that he has reason to believe that such trespassers will not discover it, and

 

(b)  the possessor has failed to exercise reasonable care to warn such trespassers of the condition and the risk involved.
